dc.description.abstractУ статті досліджені напрями вдосконалення контролю за діяльністю та відповідальність центральних органів виконавчої влади. Встановлено, що для організації діяльності центральних органів виконавчої влади важливе значення має категорія політичної відповідальності як вид соціальної відповідальності спеціальних суб’єктів перед населенням. Сучасною тенденцією організації діяльності центральних органів влади в Україні визначено розширення меж і вдосконалення громадського контролю стосовно діяльності центральних органів виконавчої влади, провідну роль у цьому процесі відіграє розвиток засобів втілення принципів відкритості, прозорості, доступності інформації про діяльність органів виконавчої влади. Наголошено, що державний контроль залишається важливим для належного і повного виконання центральними органами виконавчої влади поставлених перед ними завдань, попередження фактів зловживань владою, перевищення владних повноважень та інших порушень норм законодавства України. Серед сфер його вдосконалення вказані необхідні зміни законодавства у сфері боротьби з корупцією, механізму декларування доходів і видатків осіб, уповноважених на виконання функцій держави, роботи системи подання й оприлюднення декларацій осіб, уповноважених на виконання функцій держави, тощо. Наголошено, що підвищення ефективності контролю і рівня відповідальності є одними із перспективних шляхів впливу на забезпечення ефективності функціонування центральних органів виконавчої влади. Встановлено, що контроль дозволяє виявити відхилення в розвитку системи від заздалегідь визначених показників, а відповідальність забезпечує ефективність контролю, надаючи можливість покарати осіб, винних у настанні таких відхилень, за умови доведення вини та наявності складу правопорушення, а також здійснюючи превентивний вплив на інших суб’єктів. Доведено, що удосконалення механізмів контролю без удосконалення механізмів відповідальності значно знижує ефективність проведених заходів, охорона муніципальної влади від тиску з боку центральних органів виконавчої влади через контроль і відсутність відповідальності сприяє невиконанню делегованих повноважень.
dc.description.abstract1The article explores the areas of improving control over the activities and responsibilities of central executive bodies. It is established that the category of political responsibility as a type of social responsibility of special subjects to the population is of paramount importance for the organization of the activity of central executive bodies. It is noted that the current trend of organizing the activities of central authorities in Ukraine is the expansion of borders and improvement of public control over the activities of central executive bodies, for which further development of means of implementing the principles of openness, transparency, accessibility of information on executive bodies. including through the use of web resources. It was emphasized that state control remains important for the proper and full implementation of the tasks set before them by the central executive bodies, prevention in stopping the facts of abuse of power, abuse of power and other violations of Ukrainian legislation. Among the areas of its improvement are the necessary changes in anti-corruption legislation, the mechanism for declaring income and expenditure of persons authorized to perform state functions, the system of submission and publication of declarations of persons authorized to perform state functions, etc. It is emphasized that improving the effectiveness of control and the level of responsibility are one of the promising ways to influence the effectiveness of the central executive bodies. It is established that control allows to detect deviations in the development of the system from predetermined indicators, and responsibility ensures the effectiveness of control, providing an opportunity to punish those guilty of such deviations, provided guilt and the presence of the offense, as well as exercising preventive influence on other actors. It is determined that the category of political responsibility as a type of social responsibility of special subjects (bearers of power that make political decisions) to the population is of paramount importance for the organization of the activity of central executive bodies. It is proved that the improvement of control mechanisms without the improvement of responsibility mechanisms significantly reduces the effectiveness of the measures taken, the protection of municipal authorities from pressure from central executive bodies through control and lack of responsibility contributes to non-delegated powers.
